Public Meeting for the Genesee County Central Corridors Study

Batavia, New York - The Town of Batavia, in partnership with the City of Batavia and Genesee County, will host a public meeting to review the findings and recommendations of the Genesee Central Corridors Study. The Study examined transportation needs along the primary state corridors in the heart of Batavia. The meeting will be held on Tuesday, March 22, 2011 at 7 p.m. at the Town of Batavia Town Hall.

The meeting will provide an overview of the existing and future traffic conditions within the study area and review recommended transportation strategies to manage Batavia's development over the next 20 years. Meeting participants will have an opportunity to review recommendations and concepts and provide their feedback.

The study area encompasses Routes 5&20, 33, 63 and 98 in the City and portions of the Town Batavia. These corridors have experienced significant change over the last decade, with more development expected in the future. The purpose of this study has been to better understand current and future conditions and identify where transportation enhancements should be made now and in the future.

Consolidated Charter Task Force

The City of Batavia and Town of Batavia are looking for candidates to be appointed to the Consolidated Charter Task Force responsible for preparing a revised City Charter to incorporate the area currently outside of the City in the Town of Batavia. The Task Force will be continuing a joint effort by the City and Town to investigate the possibility of consolidating the City and Town into One Batavia. The Consolidated Charter Task Force, with the assistance of a facilitator, are expected to draft a Consolidated City Charter, to be reviewed by the public, City Council and Town Board. The selection process for the Consolidated Charter Task Force shall consist of interviews conducted by an Interview Committee consisting of three (3) City Council members and three (3) Town Board members. Upon the Interview Committee's recommendations, the City Council and Town Board will jointly appoint the Consolidated Charter Task Force. The Consolidated Charter Task Force shall consist of four (4) City residents and four (4) Town residents. All members of the Task Force must be at least eighteen (18) years old; however, individuals in following categories shall not be considered for inclusion on the Task Force: all members of the City Council and the Town Board, all members of the Planning Boards and the Zoning Boards of Appeals for both the City and Town, all employees of the City and the Town and all spouses of any individuals in the above three categories. Applications for the Consolidated Charter Task Force are available at the City Clerk's Office, One Batavia City Centre, in the City of Batavia and the Town Clerk's Office, 3833 West Main St. Rd., in the Town of Batavia. Applications can also be downloaded from the City website: www.batavianewyork.com and the Town website: Consolidated Charter Task Force Application. Applications must be returned to either the City Clerk's Office or Town Clerk's Office. The deadline for applications is December 10, 2010.

FOR IMMEDIATE RELEASE

The Batavia Town Board has scheduled a public informational meeting on the draft Conceptual Plan for the development of the Batavia Town Park on Galloway Road for June 30, 2010 at 7:00pm. The draft Plan and accompanying report incorporate many of the suggestions made by participants in the public workshop held at the Town Hall in January.

The 62-acre park is envisioned to accommodate a variety of passive recreational activities, including fishing, picnicking, hiking, and nature observation. Phase I of the park development will include picnic pavilions, restrooms, an ADA-accessible fishing dock, gazebo, and trails. Future development is proposed to include a park lodge, playground and amphitheater.

NOTICE FOR PUBLIC HEARING ON

FIRE PROTECTION CONTRACT FOR 2011

PUBLIC NOTICE IS HEREBY GIVEN, that a Public Hearing will be held Wednesday, December 15, 2010, by the Town Board of the Town of Batavia, Genesee County, New York, at the Batavia Town Hall located at 3833 West Main Street Road beginning at 6:55 P.M. of that day and for the purpose of considering contracting with the Town of Batavia Fire Department, Inc. for fire protection services to be furnished by the Town of Batavia Fire Department, Inc to the Fire Department District established in the Town of Batavia and known as the "Town of Batavia Fire Protection District" upon the following general terms, to wit:

1. The Town of Batavia Fire Department, Inc. shall answer and attend upon all calls in said District;

2. The Town of Batavia Fire Department Inc., shall purchase and maintain such property, crime, dishonesty bond and liability insurance as it deems prudent to protect its interests. Such insurance shall include Automobile Liability, General Liability naming the Town of Batavia, its agents and employees as Additional Insureds, Contractural Liability for this Contract and should include Ambulance Attendants Professional Liability, Volunteer Fire Department Errors and Omissions Liability and Liquor Law Liability coverages. Liability limits of at least $1,000,000.00 each occurrence, claim or incident are recommended but not required. A Certificate of all liability insurances, providing the Town with at least 30 days written notice of cancellation or nonrenewable, shall be furnished to the Town Attorney, Town Hall, 3833 West Main Street Road, Batavia, New York, 14020.
The Town of Batavia Fire Department, Inc. shall also indemnify and hold harmless the Town of Batavia, its agents and employees from all claims, suits, loss, damages, injuries, liability, cost and expenses arising from the services provided for in this contract and from the activities of the Fire District, its officers, employees and volunteers to the extent this provision is insured by the Town of Batavia Fire District.

3. The Town of Batavia Fire Department, Inc. shall maintain public liability and property damage insurance policies for the benefit of said District and the Town of Batavia, and shall hold said District and Town harmless for losses not covered by insurance;

4. The Town of Batavia Fire Department, Inc. shall be responsible for loss or damage sustained in fire apparatus or other equipment while attending fires in said District;

5. The Town of Batavia and the Town of Batavia Fire Protection District shall pay or provide insurance coverage for authorized items;

6. The Town of Batavia Fire Department, Inc. shall participate in the Genesee County Mutual Aid Plan and reserves certain rights pertaining to said participation;

7. The Town of Batavia Fire Department, Inc. shall reimburse the Town of Batavia should its equipment not be usable;

8. For such services the Town of Batavia Fire Department shall receive the yearly sum of Seven Hundred Twenty-Two Thousand Eight Hundred Twenty-Nine and 00/100 Dollars ($722,829.00).

9. The Town of Batavia shall plow and provide routine maintenance to the driveway and parking area of the Fire Department's Fire Hall;

10. The Town of Batavia Fire Department, Inc. shall provide financial data and records to the Town of Batavia.

11. The contract shall run for one (1) year from January 1, 2011 and shall expire on December 31, 2011

TO CONSIDER ADOPTING A PROPOSED LOCAL LAW

PUBLIC NOTICE,is hereby given that there has been presented to the Town Board of the Town of Batavia, New York on the 17th day of November, 2010, proposed Local Law No. 4 of 2010, entitled "A Local Law to Amend the Dog Control Law of the Town of Batavia", as summarized as follows:

1. Pursuant to recent amendments of the New York State Agriculture and Markets Law, all Towns in the State of New York shall now be completely responsible for administering the licensing, identification and control of the dog population.

2. All dogs in the Town of Batavia that are the age of 4 months and older must be annually licensed with the Town Clerk.

3. Fees will be charged as set by the Town Board by Resolution, subject to the periodic review by the Town Board, which may be changed by Resolution, if deemed necessary; for the following:

  • A. Spayed or neutered dogs, to include a New York State assessment.
  • B. Unspayed or unneutered dogs, to include a New York State assessment.
  • C. All dogs found unlicensed or not renewed at the time any enumeration is conducted.
  • D. Replacement tags.
  • E. A late fee for any license sixty (60) days past due.
  • F. Impoundment fees.

4. The Town will be issuing purebred licenses.

5. The Town will not allow licensing of dogs by a shelter or another municipality.

6. The Town will exempt guide dogs and other service dogs from the license fees.

7. A night quarantine will be enforced between sunset and one (1) hour after sun rise.

8. Provisions for enforcement of the Dog Control Law by a Dog Control Officer, including the seizure, impoundment, forfeiture, adoption and/or euthanasia of dogs, if necessary.

9. Penalties for offenses as established in the New York State Agriculture and Markets Law.

PLEASE TAKE FURTHER NOTICE that on 15th day of December, 2010, at 6:50 p.m. of that day the Town Board of the Town of Batavia, New York will conduct a public hearing at the Batavia Town Hall, located at 3833 West Main Street Road, in the Town of Batavia, New York, for the purpose of considering the advisability of enacting said proposed Local Law, at which time and place all persons interested will be heard.

NOTICE OF BOND RESOLUTION

TOWN OF BATAVIA

PUBLIC NOTICE IS HEREBY GIVEN, that a bond resolution, a summary of which is published herewith, has been adopted by the Town Board of the Town of Batavia, County of Genesee, on November 17, 2010 and the validity of the obligations authorized by such resolution may be hereafter contested only if:

(1) (a) such obligations were authorized for an object or purpose for which the Town of Batavia is not authorized to expend money or

(b) the provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication; or

(2) such obligations were authorized in violation of the provisions of the Constitution of New York.

SUMMARY OF BOND RESOLUTION

The following is a summary of a bond resolution adopted by the Town Board of the Town of Batavia on November 17, 2010. The bond resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of said serial bonds, in an amount not to exceed $270,140, offset by any federal, state, county and/or local funds. The proceeds from the sale of the obligations authorized in said resolution shall be used for the specific purpose of financing the construction of improvements in the Wortendyke and Pike Roads Water District in the Town. Such improvements include, but are not limited to, the construction and installation of approximately 4,600 linear feet of new eight (8) inch water main along a portion of Wortendyke Road starting at and connecting with an existing water transmission line on Wortendyke Road located at the intersection of NYS Route 33 (Pearl Street Road); and then running northerly along Wortendyke Road to the intersection of South Main Street Road, together with all related right-of-way costs, site work and other ancillary work, including hydrants, valves, apparatus and other improvements and costs incidental thereto for the foregoing purpose. The estimated maximum cost of the project is $270,140. The period of probable usefulness for said purpose is 40 years. A copy of the resolution summarized herein is available for public inspection during normal business hours at the Office of the Town Clerk, located in the Town Hall, 3833 West Main Street Road, Batavia, New York.

Public Information Meeting for the Genesee County Central Corridor Study

Batavia, New York – The Town of Batavia, in partnership with the City of Batavia, will host a public information meeting to discuss the Genesee Central Corridor Study. The intent of the study is to examine transportation issues along the primary travel corridors in the heart of Batavia. The meeting will be held on Thursday, March 11, 2010 at 7 p.m. at the Town of Batavia Town Hall.

The meeting will provide an overview of the planning process and a summary of existing traffic and land use conditions. Attendees will participate in a brainstorming exercise to identify traffic issues and ideas that may be addressed in the study.

The study area encompasses Routes 5 & 20, 33, 63 and 98 in the City and a portion of the Town of Batavia. These corridors have experienced significant change over the last decade, with more development expected in the future. This study will identify current transportation conditions and provide recommendations for how and where to improve our transportation corridors now and into the future.

Park Planning Workshop Summary

A "Park Workshop" was held at the Batavia Town Hall on January 27, 2010.

Stuart I. Brown Associates, Ingalls Planning & Design and Steve Mountain presented on the Park site along with some issues and opportunities that need to be considered when planning and designing the park.

Community members after the presentation were put into two groups to brainstorm ideas for facilities at the new park and prepare a concept site plan. Everyone that attended had great ideas that ranged from, but not limited to, "passive" recreational facilities, such as picnic areas, nature trails, fishing pond shaped to look like a water animal, community garden and a seasonal corn maze. At this time, the park is not envisioned to include athletic fields for use by organized sports but having a large graded grass area for multi use purposes. Park Planning & Design Workshop

A "Park Workshop" will be held at the Batavia Town Hall on January 27, 2010 at 6:30 P.M.

The Town of Batavia has acquired land along on Galloway Road with the intention of developing a Town Park. The Town has retained Stuart I. Brown Associates and Ingalls Planning & Design to prepare the conceptual plan for the park.

Community members are invited to participate in a planning and design workshop to brainstorm ideas for facilities at the new park and to help prepare a concept plan for the park.

The purpose of the workshop is to hear what community members want to see in the park and develop alternative concepts that will ultimately inform the park's design. The workshop will begin with a brief presentation providing a project site overview along with some issues and opportunities that need to be considered when planning and designing the park.

Preliminary ideas for the park include a variety of "passive" recreational facilities, such as picnic areas, nature trails, fishing pond, and community garden. At this time, the park is not envisioned to include athletic fields for use by organized sports.

Planning & ZBA Members

Planning & ZBA Members terms expire 12/31/09. Anyone interested in serving on one of the Boards, may submit an application to the Town Clerk's Office by December 30, 2009. The "Application for Appointment" can be found under the downloadable forms



Deer Management Permits

Town Clerk's Office will be open on Sunday, November 1 from 9:00 a.m. to 1:00 p.m. for the issuance of Deer Management Permits, which will be available beginning November 1st on a "first come, first serve, basis" in the following areas:

8A, 8F, 8G, 8H, 8J, 8N
9A, 9F



November Board Meeting Change

The November Regular Town Board Meeting has been changed to Tuesday, November 17, 2009 at 7:00 P.M.



Open Burning Regulations

New York Department of Conservation (NYSDEC) has new "Open Burning Regulations". For information, please visit the NYSDEC website at www.dec.ny.gov. Any questions regarding the new regulations should be directed to the NYSDEC.



The Census Bureau

The Census Bureau will be going door to door from April to July, 2009 for the 2010 Census.



Dog Enumeration

The Town of Batavia is conducting a Dog Enumeration, beginning May 4. Betsy Torrey is the Dog Enumerator. Any dog found unlicensed will be charged an additional fee of $5.00.



City/Town Consolidation Plan

Greater Batavia NY includes the City and the Town of Batavia. The City and Town were recently awarded a NYS grant and are developing a plan to create one unified government. Click here to read more.
